Uncontested divorce intake

For Louisiana couples who agree on getting divorced. Takes about 5 minutes. Your answers go straight to Attorney Kaitlin Mayeux.

Are you the wife or the husband?

You're the person filing. We use this to word your papers correctly and to ask only the questions that apply to you.

Have you and your spouse lived separate and apart for at least 180 days in a row, without getting back together?

"Separate and apart" means you haven't lived together as a married couple. Moving back in together, even briefly, can restart the 180 days.

Were any children born of the marriage, or adopted by the two of you during the marriage?

Include children who are now adults. Stepchildren who were never legally adopted don't count.

List each child's full legal name and date of birth.

Is either of you currently pregnant?

Louisiana law requires this to be addressed in the divorce papers.

Is your marriage a covenant marriage?

A covenant marriage is a special type you would have chosen on purpose, usually with required premarital counseling and a signed declaration. Most marriages are not.

Do you or your spouse live in Louisiana right now?

At least one of you must live in Louisiana to file for divorce here.

The day you stopped living together as a couple. It must be more than 180 days ago for this type of divorce. If you're not sure of the exact day, use your best estimate and tell us in the notes.
Enter the date you separated.

Your children

Because you have a child under 18, your papers can also cover custody and child support. These questions are only about your children under 18.

Do you and your spouse agree on custody?

Custody means who the children live with and how decisions about them get made. If you don't agree yet, that's OK. Finish the form and Kaitlin will call you.

A few more questions

Will your spouse sign a form saying they received the divorce papers?

It's called a waiver of service. Your spouse signs it in front of a notary, so a sheriff doesn't have to deliver the papers. It usually makes the divorce faster and cheaper.
Please answer this question.

Is your spouse on active duty in the military, or deployed?

Include the Reserves or National Guard if they're on active orders. Federal law adds protections for service members, so Kaitlin needs to know this before anything is filed.

Did you change your last name when you got married?

For example, if you took your spouse's last name.
This form only handles the divorce itself. Splitting property is a separate step. This just tells Kaitlin what to expect.
Anything unusual: a prior divorce, a recent move, a safety concern, or questions for Kaitlin.

Review & send

Check everything carefully. These details go into your court papers exactly as written.

Leave these blank for a new filing. The dates fill the certificate of service and the key dates on the review sheet. You can type them into the PDF later (once fills every page), or come back here and rebuild once the petition is filed.

Office mode: "Build packet" builds the files here (links appear below) and does not email them. Court and parish are filled in from your choice and stay editable in Acrobat.
